This Privacy Policy explains how Versant Media, LLC and its affiliates (“Versant Affiliates”) (collectively, “Versant” “we” or “us”) collect, use, and disclose personal data from and about you when you use our websites, mobile applications, interactive TV applications, voice-activated skills, other digital services, connected devices, and off-line services that link to this policy, or if you otherwise interact with or engage in business with us (“Versant Services or Services”).
This Policy also outlines the rights you may have regarding your personal data, depending on where you live. This Privacy Policy applies to the Versant Services throughout the world. Any additional privacy terms that relate to specific Versant products or services should be read in conjunction with this Policy.
We offer Versant Services through a wide range of businesses and under many different brands. The data controller of your personal data will be the Versant company which provides the Versant Services to you or does business with you.
Please note that certain Versant businesses (including, but not limited to, certain Fandango-branded businesses, such as Fandango, Fandango at Home, and FandangoNow; Vudu; Rotten Tomatoes; Flixster; MovieTickets.com; Movieclips; Movies.com; and Activaterewards.com) (collectively, “Fandango”) are owned by Versant Media, LLC. and Warner Bros. Discovery. Data that is collected from these Fandango businesses is collected, owned and processed by Versant as outlined in this Privacy Policy and by Warner Bros. Discovery. This Policy does not apply to information we process regarding members of our workforce in that capacity (e.g., employees, former employees, and contractors) or candidates for employment with us.

Each Versant Service’s collection and use may vary. We collect this personal data from directly from you or others, automatically from your device(s), and/or from third party sources as described below. We may use any or all of this data to comply with the law, detect or prevent fraud, for safety and security purposes, and to defend our legal rights. Further details about each of the purposes is set out in the “Additional Information on Purposes” table below.

We may combine all the personal data we collect from or receive about you for the outlined purposes. We may aggregate or deidentify your personal data and may use, share, rent or sell aggregated or deidentified information for any purpose, and such information is not subject to this Privacy Policy.
2. WHEN WE DISCLOSE YOUR PERSONAL DATA
We may disclose your personal data as described below. In some cases, such disclosures may be considered a sale, share, or use of your personal data for targeted advertising; for more info on your right to opt out of such activities, see “Your Rights” section below.
- Affiliates: Versant Affiliates, to help better tailor services, products, marketing, and advertising for Versant and such Affiliates to you and to other existing and potential customers. We may share all categories of information across our Affiliates. In addition, business information may be shared for business operational purposes. For Fandango, they may also share personal data with Warner Bros. .
- Service Providers: We engage vendors to perform business purposes on our behalf and provide information to them to enable them to provide us with such business purposes, including research and analytics, hosting, transaction and payment processing, artificial intelligence tools to perform our business functions (e.g., analytics, customer service), promotion administration, fraud prevention, identity management, acquisition and other services. Service providers may use such information for their operational purposes in order to provide their services to us.
Advertisers, Advertising Technology Providers, Analytics Vendors, and Related Third Parties: We may disclose personal data about you and your device(s) (which may be considered a “sale,” “sharing,” or use of your data for “targeted advertising”), including how use the Versant Services and interact with content or ads, to better tailor services and products, and for marketing and advertising on our Services and on third-party services for the benefit of Versant and/or for the benefit of other third parties.
To enable these purposes, we may share certain contact and account registration information, demographics and interest information, user-generated content, device information and identifiers, connection and usage data, geolocation data, transactional data, public and commercial information, and social media information with these third parties.
These third parties may use their own tracking technologies, including but not limited to cookies, pixels, beacons, software development kits (“Cookies”) to collect or request information about you, please see our Cookie Notice for more details. The disclosure of this information is considered a sale of personal data or share for targeted ads under certain laws as described in “Opt Out of Sale of Personal Data and Processing for Targeted Ads ” section below.
Versant Partners: We may disclose your personal data to certain third-party partners. These partners may include one or more of business partners, loyalty program partners, former related companies like NBCUniversal and its brands, advertisers, marketplaces, licensees, and commercial data resellers (collectively “Data Partners”).
Depending on the partnership, we may disclose certain categories of information including contact information, identification and demographic and interest information, transactional information, user-generated content that you provide, research and feedback, device information and identifiers, connection and usage information, public and commercial information, and social media information. In some instances, such disclosure is at your direction. Partners may use your information pursuant to their own policies, which may be considered a “sale,” “sharing,” or use of your personal data for targeted advertising (see the “Opt Out of Sales of Personal Data and Processing for Targeted Ads” section below).
For example,
- If you enter a contest or sweepstakes sponsored by a third party, we may disclose the data you provide for that entry with the sponsor.
- If we offer services on a co-branded basis with another business, we may disclose your personal data to that co-branded partner.
- When using GolfNow’s sites and services, we will provide your information to golf clubs to enable you to book reservations or access on-site amenities. When using SportsEngine, your information may be shared with the coaches and sports teams you join.
- When you book travel packages with us that include goods or services provided by third-party partners, such as airlines, ground transportation providers, third-party hotels, and travel insurance providers, we will provide your information to those partners to provide you such packages.
- If you access Versant content through our Services by using a third party, such as your cable provider or a device partner, we may disclose certain data to those third parties, including for service authentication, reporting, and to enable advertising.
- If you make a purchase for a third-party product in one of our online shops, we may disclose the information you provide to allow for the fulfillment of that order.
- We also share such information with Data Partners to use for their own purposes, including marketing and advertising purposes. The disclosure of this information may be considered a “sale” of personal data or share for targeted ads under certain privacy laws as described in “Opt Out of Sale of Personal data and Processing for Targeted Ads” section below.
- Social Media Platforms: We may disclose your information to social media platforms (e.g., Meta, Tik Tok) acting in that capacity, for example, if you click on a Facebook “like” button on a Versant Service, the “like” may appear on your Facebook account. Or you may choose to provide information directly on these platforms using sharing plug-ins. To control this sharing of information, please review and adjust your privacy settings for the relevant social network. Depending on your privacy settings and actions on such network, we may disclose contact information, identification and demographic and interest information, user-generated content, device information and identifiers, connection and usage data, and social media information. Please be aware those social media platforms may be Joint Controllers of your personal data. Further information (including about the lawful basis relied upon which such controllers rely and how you may exercise your data subject rights) can be found in their privacy policies.
- Research and Measurement Companies: We provide information about content you view on the Versant Services with video measurement services such as Nielsen TV Ratings, as well as other analytics providers. See Your Rights and Your Choices sections for more information.
- Other Users or Consumers: Depending on the Versant Service, you may be able to engage with other members of the Service or the public. This may make the name and photo associated with your profile and any comments or user-generated content you provide visible to other members of that Service or the general public. If the information is available to the general public, it may also be searchable by search engines.
- Law Enforcement, Regulators, Anti-fraud Coalitions, and other groups: We disclose any of the categories of information we collect, as appropriate, with these third parties in order to: protect and enforce the legal rights, privacy, and safety of ourselves and our visitors; protect against possible fraud or other illegal activity; respond to requests from government and other authorities; and otherwise comply with legal process.
Other Sharing
With your appropriate consent when required, and consistent with applicable law, we may disclose your video viewing behavior with third parties including service providers, advertising companies, analytic partners, and social media sites.
Sale or transfer of all or part of our business or assets
In the event that Versant or any Versant Affiliate is involved in a merger, acquisition, transfer of control, bankruptcy, reorganization or sale of assets, we may sell or transfer the information described in this Privacy Policy as part of that transaction or diligence associated with or in contemplation of such matters.
3. LEGAL BASIS FOR USE OF YOUR PERSONAL DATA
The laws of some jurisdictions, such as the European Union, the UK, require companies to tell you about the legal basis for using, sharing, or disclosing your personal data. To the extent those laws apply, we may rely on the following legal bases:
- Performance of a contract: where use of your personal data is necessary to provide you with Versant Services under a contract, for example the relevant Terms of Service.
- Legitimate interest: where use of your personal data is necessary for our or others legitimate interests and where the use is not outweighed by your rights and interests. Below are some examples of such interests:
- providing Versant Services
- improving our Services and developing new ones
- recognizing and better understanding our users, including across platforms
- conducting security and fraud prevention activities
- marketing and promoting our content and services
- building and managing business-to-business relationships
- conducting compliance and risk management activities
- providing and managing access to our systems
- Legal obligation: where use of your personal data is necessary to comply with laws and regulations such as those relating to anti-bribery and corruption and anti-money-laundering, complying with requests from government bodies or courts, or responding to litigation.

Depending on where you live, you may have certain rights with respect to your personal data.
Privacy Rights
California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah and Virginia residents, in addition to residents of Canada, EEA, UK, or Switzerland, may have the following rights depending on your jurisdiction:
- Right to Know/Access: the right to access certain personal data we hold about you, in some cases in a portable format, if technically feasible, including
- Specific pieces of personal data we maintain about you.
- Information about the categories of personal data we process about you and how we process it (for California and Oregon residents).
- Right to Correct: the right to update or correct inaccurate personal data we maintain about you.
- Right to Delete: the right to delete certain personal data we have collected from or about you.
- Right to Restrict: the right to restrict the use of or object to the processing of your data if you are in the UK, EU, or Switzerland.
- Right to Request Specific List of Third Parties: for Minnesota and Oregon residents, the right to request a list of the specific third parties, other than natural persons, to which we have disclosed personal data.

- Right to Non-Discrimination: the right not to be discriminated against (as provided for in applicable law) for exercising your rights under applicable laws.

Exceptions to and Impacts of Exercising Privacy Rights

Many of the above rights are subject to exceptions and limitations.
Some Versant Services can only be provided if we have your personal data, therefore deletion of your data will result in termination of such Services.

Verification
We will take reasonable steps to verify your identity, including authenticating you through the email address. We may require further documentation such as a password and user ID before granting access to your personal data.
Appeal and Complaint
If you have any unresolved concerns, you may have the right to complain to your data protection authority.
Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, and Virginia residents may appeal the denial of a request by contacting us.
Opt Out of Sale of Personal Data and Processing for Targeted Ads
California, Colorado, Connecticut, Delaware, Iowa, Minnesota, Montana, Nebraska, New Hampshire, Oregon, Tennessee, Texas, Utah, and Virginia residents may opt out of the “sale” of their personal data. Such residents may also opt out of the sharing or processing of their personal data for targeted advertising. We disclose data as described below that may considered a “sale” of personal data or share or processing of personal data for targeted ads under certain privacy laws. We do not knowingly sell or share or process for targeted ads, the personal data of users known to be under 18.
- We provide third parties such as advertisers and advertising technology providers and others data including contact and account information, such as email address; commercial and transactional information, such as your purchase history; identification and demographics; device information and identifiers, such as IP address, and unique advertising identifiers and Cookies; connection and usage information, such as browsing history or app usage; geolocation information, such as city; and inference data. Those parties use such data to recognize you across devices, develop advertising segments, and enable marketing to you and delivery of targeted advertising on the Versant Services or on other sites and services for Versant’s or for a third party’s benefit. Advertising, including targeted advertising, enables Versant to provide you certain content for free and provide relevant offers to you.
- We also share with certain Data Partners (e.g., commercial data providers) information (including from third parties) such as contact and account information (e.g., email address); commercial transactional information, such as your purchase history; connection and usage data; identification and demographics; device information and identifiers, and inferences to use for their own purposes, including for marketing and advertising.
- As described in Affiliates above, we may also provide the data described in this section to our Affiliates to recognize you across devices, to use for their own purposes, including their own marketing and for targeted advertising. In certain locations, such as California, disclosure to certain Affiliates (such as those that are not co-branded) is considered a sale or sharing for targeted advertising. In many locations, disclosure to Affiliates is not a sale or sharing for targeted advertising.
How to Opt Out of Sale, Sharing or Processing of Personal Data for Targeted Ads
If you or (in certain states where required by law your authorized agent) would like to opt out of Versant’s use or disclosure of your data for such purposes (to the extent this is considered a sale, share, or targeted advertising), you may do so in the footer or settings menu by selecting “Your Privacy Choices” link and following the instructions provided.
Please note, to opt out of all sales, sharing, and processing of your personal data for targeted advertising, you may need to also Contact Us. Please note, if you use different browsers, devices, or services you will need to make your elections separately.
You may still receive advertising, including personalized ads based on Versant data on the Services.
Please note, if we do not detect that you are in California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, Oregon, Tennessee, Texas, Utah, or Virginia, the opt out of sale or sharing/processing for targeted advertising data choices may not apply even if you take the actions described above.
Please note that if you have a legally-recognized browser-based opt out preference signal turned on via your device browser (such as Global Privacy Control), we recognize such preference in accordance and to the extent required by applicable law.
To the extent we use precise location data for targeted ads (which we do solely to the extent permitted by applicable law), you can change your precise location settings in your mobile device settings.
Additional Information for Nevada Residents
Certain Nevada consumers may opt out of the sale of “covered information” for monetary consideration. As applicable to Versant, “covered information” includes first and last name, address, email address, phone number, or an identifier that allows a specific person to be contacted either physically or online. As described above, Versant may share certain of this information to third parties, including in some instances for monetary consideration.
If you are a Nevada resident who has purchased goods or services from Versant, you may submit a request to opt out of these sales under Nevada law by Contacting Us.

Additional information for California and Colorado Residents Regarding Loyalty Programs or Financial Incentives
The Services may offer opportunities to receive certain services or benefits such as discounts or free or extended services (such as bonus streaming time or additional videos), which may require the provision of personal data. Such opportunities could be considered a financial incentive under California law (each, an “Incentive”).
Versant may also offer certain loyalty programs, such as Fandango Fanrewards (“Loyalty Programs”) that may qualify as a financial incentive under California law or “bona fide loyalty program” under Colorado law. When you sign up for Loyalty Programs, we collect your name and email address; we also collect data about your transactions in the Loyalty Program (such as your ticket purchases) and your reward activities (such as redemption). We may disclose this and other personal data as described in the section entitled “When We Disclose Your Information."
We also may sell or process data provided in connection with your Incentive or your Loyalty Program data for targeted advertising, including when we disclose it to Loyalty Program partners, advertising partners, ad networks, business partners, advertisers, marketplaces, and commercial data resellers as described in “When We Disclosure Your Information” above.
When you participate in an Incentive or Loyalty Program, you agree to the terms of that Incentive or Loyalty Program and may revoke your participation or opt-out depending on the Incentive (e.g., by opting out of emails or terminating a streaming service) or Loyalty Program (by contacting us as described Loyalty Program terms). To the extent that you request the deletion of your personal data, you may not be able to continue to participate in certain Incentives or Loyalty Programs, because we require certain personal data to provide you access or manage your account and keep track of your rewards.
To the extent we can determine the value of your personal data, we consider the value of providing you with a more personalized experience as well as the expenses we incur in providing Incentive or Loyalty Programs that are reasonably related to the costs associated with offering the Incentives.
Third Parties List – Shine the Light (California Residents only)
California’s Shine the Light Law (CA Civil Code § 1798.83) allows California residents to request a list of all the third parties to which we have disclosed certain “personal data” (as defined by California’s Shine the Light law) during the preceding year where the business knows or reasonably should know that the third parties used the personal data for those third parties’ “direct marketing purposes.” Direct marketing purposes means “the use of personal data to solicit or induce a purchase, rental, lease, or exchange of products, goods, property, or services directly to individuals by means of the mail, telephone, or electronic mail for their personal, family, or household purposes. ” However, a business is not required to provide this information where it adopts and discloses, in its privacy policy, a policy of not disclosing “personal data” to third parties for their “direct marketing purposes” 1) unless the resident first affirmatively agrees or 2) if the resident has exercised an option that prevents that information from being disclosed. Versant maintains such a policy and thus is not required to provide this information. To exercise your opt out right from this activity, to the extent we engage in it, follow the instructions at “How to Opt Out of Sale, Sharing or Processing of Personal Data for Targeted Ads” above.
6. YOUR CHOICES
In addition to the legal rights that may be available to you describe above, Versant may provide you with further choices related to your personal data as described in this section. You do not need to select any of these other choices in order to exercise the legal rights available to you under applicable privacy laws.
Marketing Opt Outs
You can opt-out of or unsubscribe from our promotional emails by clicking the “unsubscribe” link they contain: please note if you do so, that we may continue to send you emails relating to administrative and transactional interactions with us, such as emails about orders, changes to our policies, or content and services that you have specifically requested.
You may also unsubscribe from receiving certain text (SMS) or multimedia (MMS) messages by replying “STOP” to the number sending the message. When we engage in SMS communications with you, separate terms we present to you may apply or supplement these terms.
Cookies and Similar Technologies
We and our service providers, advertisers, and other third parties use Cookies to recognize you on, off, and across Versant Services and your devices. For more information about the use of Cookies and similar technologies on the Versant Services (including your opt-out choices) please see our Cookie Notice.
Mobile App and Connected Devices
Depending on the device you use, you may be able to manage your advertising and location preferences through your device settings and as outlined in our Cookie Notice Many operating systems provide their own instructions on how to prevent the delivery of tailored in-application advertisements. We do not control how the applicable platform operator allows you to manage personalized in-application advertisements. You should review your device manufacturer’s support materials and/or the device settings for the respective operating systems for more detail on how to manage such preferences.
You can also choose to connect external apps and devices to certain Versant Services. You may be able control the personal data that you share with Versant using your app or device settings.
You can stop all collection of information by a mobile app by uninstalling the app.
