This notice provides additional information to California residents, including as required by the California Consumer Privacy Act (“CCPA”), about the categories of personal data that we collect from California residents, the purposes for which we use the data, the categories of third parties to whom we disclose data for business purposes, and the categories of third parties to whom we “sell” or “share” such personal data. You also have specific rights over your personal data, including the right to opt out of sharing or selling of your data. For more information, on those rights and how to exercise them, see the “Your Rights” section of Versant’s Privacy Policy.
Please note, Versant’s collection and use of your personal data may vary across Services and our uses of your personal data are to the extent permitted by and in compliance with applicable law. In particular, where we indicate we disclose personal data in a category of data to entities for a business purpose or sell or share that data, please note we may only disclose or sell or share a subset of the data or data types that fall within that personal data category.
Versant may use any or all of the categories of data to comply with the law, detect or prevent fraud, for safety and security purposes, and to defend our legal rights. Further detail about each of the purposes is set out in the “Additional Information on Purposes” table in the Privacy Policy. Opt Out of Sale of Sales and Share of Personal Data
California residents may opt out of the “sale” of their personal data or “sharing” their personal data for targeted advertising. If you or your authorized agent would like to opt out of Versant’s use or disclosure of your data for such purposes (to the extent this is considered a sale or share, or targeted advertising), you may do so in the footer or settings menu by selecting “Your Privacy Choices” link and following the instructions provided. Please note, to opt out of all sales, sharing, and processing of your personal data for targeted advertising, you may need to also complete our web form located here. If you use different browsers, devices, or services you will need to make your elections separately.
You may still receive advertising, including personalized ads based on Versant data on the Services.
Please note, if we do not detect that you are in California, the opt out of sale or sharing/processing for targeted advertising data choices may not apply even if you take the actions described above.
Please note that if you have a legally-recognized browser-based opt out preference signal turned on via your device browser (such as Global Privacy Control), we recognize such preference in accordance and to the extent required by applicable law.
Right to Limit Sensitive Personal Data
We may use location data as allowable by law for purposes including analytics and to enable marketing to you and the delivery of targeted advertising on the Versant Services or other sites, such displaying an ad relevant to your precise location data. You can change your precise geolocation permissions for our mobile apps in your mobile device settings.
How Long We Keep Your Personal Data
We will keep your personal data only for as long as it is necessary to fulfill the purposes described above, unless a longer retention is required or permitted by law. In determining how long to retain such data, we consider the amount, nature and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we process the information, applicable legal requirements, and our legitimate interests. The purposes for which we process information (as well as the other factors listed above) may dictate different retention periods for the same types of information. For example, we retain your email address as an authentication credential (where applicable) as long as you have an account with us and an additional period of time after that for our legitimate interests and for our fraud and legal compliance purposes. If you opt out of email marketing, we maintain your email on our suppression list for an extended time to comply with your request.
We may delete or de-identify your data sooner if we receive a verifiable deletion request, subject to exemptions under applicable law. The retention period that applies to your personal data may vary depending on the Versant Services you use and how you interact with them. Some Versant Services may provide additional details on their data retention practices, so we encourage you to consult their website and/or FAQs. In addition, in the event you have an account that holds credits, point balances, or other entitlements, we may continue to hold the account to allow you to obtain the benefit in accordance with the relevant terms and conditions.

Additional information for California and Colorado Residents Regarding Loyalty Programs or Financial Incentives
The Services may offer opportunities to receive certain services or benefits such as discounts or free or extended services (such as bonus streaming time or additional videos), which may require the provision of personal data. Such opportunities could be considered a financial incentive under California law (each, an “Incentive”).
Versant may also offer certain loyalty programs, such as Fandango Fanrewards (“Loyalty Programs”) that may qualify as a financial incentive under California law or “bona fide loyalty program” under Colorado law. When you sign up for Loyalty Programs, we collect your name and email address; we also collect data about your transactions in the Loyalty Program (such as your ticket purchases) and your reward activities (such as redemption). We may disclose this and other personal data as described in the section entitled “When We Disclose Your Personal Data. ”
We also may sell or process data provided in connection with your Incentive or your Loyalty Program data for targeted advertising, including when we disclose it to Loyalty Program partners, advertising partners, ad networks, business partners, advertisers, marketplaces, and commercial data resellers as described in “When We Disclose Your Personal Data”.
When you participate in an Incentive or Loyalty Program, you agree to the terms of that Incentive or Loyalty Program and may revoke your participation or opt-out depending on the Incentive (e.g., by opting out of emails or terminating a streaming service) or Loyalty Program (by contacting us as described Loyalty Program terms). To the extent that you request the deletion of your personal data, you may not be able to continue to participate in certain Incentives or Loyalty Programs, because we require certain personal data to provide you access or manage your account and keep track of your rewards.
To the extent we can determine the value of your data, we consider the value of providing you with a more personalized experience as well as the expenses we incur in providing Incentive or Loyalty Programs that are reasonably related to the costs associated with offering the Incentives.
Third Parties List – Shine the Light (California Residents Only)
California’s Shine the Light Law (CA Civil Code § 1798.83) allows California residents to request a list of all the third parties to which we have disclosed certain “personal data” (as defined by California’s Shine the Light law) during the preceding year where the business knows or reasonably should know that the third parties used the personal data for those third parties’ “direct marketing purposes.” Direct marketing purposes means “the use of personal data to solicit or induce a purchase, rental, lease, or exchange of products, goods, property, or services directly to individuals by means of the mail, telephone, or electronic mail for their personal, family, or household purposes. ” However, a business is not required to provide this information where it adopts and discloses, in its privacy policy, a policy of not disclosing “personal data” to third parties for their “direct marketing purposes” 1) unless the resident first affirmatively agrees or 2) if the resident has exercised an option that prevents that information from being disclosed. Versant maintains such a policy and thus is not required to provide this information.

Do Not Track
Some web browsers offer users a “Do Not Track” privacy preference setting in the web browser. We do not currently recognize or respond to browser initiated Do Not Track signals. Learn more about Do Not Track. Please note that “Do Not Track” is a distinct privacy mechanism from the legally recognized browser-based opt out signals described above, which we honor in accordance with applicable law.
